Terms of Service

By accessing or using Forged VA Council ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Platform. Your continued use of Forged VA Council constitutes acceptance of any updates or modifications to these Terms.

Forged VA Council is an AI-powered veteran benefits platform that provides the following services:

• Comprehensive benefits audit to identify unclaimed or under-rated VA benefits
• Step-by-step claims walkthrough and filing assistance
• Recovery tracking for submitted claims and appeals
• AI-driven analysis of service records, medical documentation, and eligibility criteria

Forged VA Council is a technology platform and does not provide legal advice, legal representation, or act as an accredited VA claims agent.

Forged VA Council is available to the following individuals:

• United States military veterans
• Active duty service members
• Eligible dependents and survivors of veterans

You must be at least 18 years of age and legally authorized to enter into a binding agreement to use the Platform.

To use Forged VA Council, you must create an account and provide accurate, complete, and current information. You are responsible for:

• Maintaining the accuracy of your account information
• Safeguarding your login credentials
• All activity that occurs under your account

Each veteran is limited to one account. Duplicate accounts may be suspended or terminated without notice.

Forged VA Council operates on a contingency basis. You pay $0 out of pocket. We only get paid when you win. If we don't win your claim, you owe nothing.

Platform Access Fee

A one-time platform access fee of $1,000 is deducted from your VA backpay after a successful claim. This fee is never charged upfront and only applies if your claim results in a backpay award. This fee covers access to the AI-powered analysis engine, claims walkthrough tools, and recovery tracking dashboard.

Recovery Fee

A 20% recovery fee applies to new monthly benefits awarded through the Forged VA Council platform. This fee is collected from your backpay, never out of pocket. See Section 6 for full details.

Payment Processing

All payments are processed securely through Stripe. Fees are collected only after the VA awards your benefits and backpay is confirmed. You never provide payment information upfront.

• The 20% recovery fee applies only to new monthly benefits discovered and recovered through the Forged VA Council platform.
• The recovery fee does not apply to benefits you were already receiving prior to using Forged VA Council.
• Both the $1,000 platform fee and the 20% recovery fee are deducted from your VA backpay after the VA officially awards your benefits. You never pay out of pocket.
• If your claim does not result in a successful award, you owe nothing.
• The recovery fee is calculated based on the first 12 months of newly awarded recurring monthly benefits.

Forged VA Council provides tools and analysis to assist with the VA benefits process. However:

• Forged VA Council is not a law firm and does not provide legal advice or legal representation.
• Results vary based on individual circumstances, service history, medical documentation, and VA determinations.
• No specific outcome, benefit amount, or disability rating is guaranteed.
• The VA retains sole authority over all benefits decisions.

As a user of Forged VA Council, you agree to:

• Provide accurate and truthful information at all times
• Submit required documents in a timely manner
• Cooperate fully with the claims process and respond to requests for information
• Not misrepresent your service history, medical conditions, or eligibility
• Not use the Platform for any unlawful purpose

All content, technology, and intellectual property associated with Forged VA Council, including but not limited to the AI analysis engine, algorithms, platform design, logos, and written content, are the exclusive property of Forged VA Council and its licensors.

You may not copy, modify, distribute, sell, or lease any part of the Platform or its content without prior written consent from Forged VA Council.

Your privacy is critically important to us. Please review our Privacy Policy for detailed information about how we collect, use, and protect your data.

Forged VA Council maintains HIPAA compliance for all medical records and health-related information. All VA data is handled in accordance with applicable federal regulations and VA data-sharing requirements.

To the maximum extent permitted by applicable law, Forged VA Council and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of benefits, loss of data, or other intangible losses arising from:

• Your use of or inability to use the Platform
• Any VA decision regarding your benefits claim
• Unauthorized access to your account or data
• Errors or omissions in the AI analysis

Forged VA Council's total liability shall not exceed the amount you paid to Forged VA Council in the twelve (12) months preceding the claim.

Either party may terminate this agreement at any time with written notice. Upon termination:

• Since Forged VA Council operates on a contingency basis with $0 upfront cost, you may cancel at any time before your claim is submitted to the VA with no financial obligation.
• If a claim has already been submitted and results in an award, the platform fee and recovery fee remain due per Sections 5 and 6.
• Forged VA Council reserves the right to terminate accounts that violate these Terms without prior notice.

Any disputes arising from or relating to these Terms or the Platform shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.

• Arbitration shall take place in the State of Delaware.
• The arbitrator's decision shall be final and binding.
• You agree to waive your right to a jury trial and to participate in any class action lawsuit against Forged VA Council.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles.
